Please read these Terms of Use carefully before using the 22Fishing app. By downloading, installing, or using the app, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and 22Fishing ("we," "us," or "our") governing your use of the 22Fishing mobile application and any related services (collectively, the "App"). By accessing or using the App, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them.

If you do not agree to these Terms, do not download, install, or use the App. We reserve the right to modify these Terms at any time. Continued use of the App following any changes constitutes your acceptance of the revised Terms.

2. License Grant

Subject to your compliance with these Terms, 22Fishing grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a mobile device that you own or control, solely for your personal, non-commercial purposes.

This license does not include the right to: sublicense, sell, resell, or commercially exploit the App; copy or adapt the App's source code; use the App to develop a competing product or service; or remove any proprietary notices or labels on the App.

3. Account Registration

To access certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You must notify us immediately at support@22fishing.com if you suspect any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

4. User Content

The App allows you to submit, upload, and share content including photos, catch logs, locations, comments, and other materials ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant 22Fishing a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display that content solely to operate and improve the App.

You represent and warrant that: you own or have the necessary rights to your User Content; your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party; and your User Content complies with these Terms and all applicable laws.

5. Prohibited Conduct

You agree not to use the App to:

  • Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Violate any applicable local, provincial, national, or international law or regulation
  • Transmit any unsolicited or unauthorized advertising or promotional material
  • Attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Use any automated means, including bots or scrapers, to access or collect data from the App
  • Interfere with or disrupt the integrity or performance of the App or the data contained therein

6. Intellectual Property

The App and all content, features, and functionality thereof — including but not limited to all text, graphics, logos, icons, images, and software — are and will remain the exclusive property of 22Fishing and its licensors. The App is protected by copyright, trademark, and other intellectual property laws.

The 22Fishing name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of 22Fishing. You may not use such marks without our prior written permission.

7. Third-Party Services

The App may contain links to or integrate with third-party websites, services, or applications that are not owned or controlled by 22Fishing. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party services you access through the App.

The App is made available through the Apple App Store and Google Play Store. Your use of those platforms is subject to their respective terms of service.

8. Location Services

Certain features of the App, such as logging catch locations and viewing nearby fishing spots, require access to your device's location data. You may enable or disable location access at any time through your device settings. Disabling location access may limit the functionality of certain App features.

We handle all location data in accordance with our Privacy Policy. You are responsible for ensuring that sharing location information complies with any applicable laws or regulations in your jurisdiction.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any information obtained through the App will be accurate, reliable, or complete. Any reliance on information provided through the App is at your own risk.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 22FISHING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless 22Fishing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by deleting the App and contacting us to request account deletion. Upon termination, your license to use the App will immediately cease. Sections 6, 9, 10, 11, and 13 of these Terms will survive any termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting a notice in the App or by other means. Your continued use of the App after any changes take effect constitutes your acceptance of the new Terms.
